UsBizHost provides Internet Presence services to a global market of customers. As such, we have certain legal and ethical responsibilities with the use of our servers and equipment involved in providing these web hosting services. To meet our legal and ethical responsibilities to our customers and to ensure each of our customers receives the quality of service paid for, we have to maintain several policies. All customers are obligated to read, agree to, and keep up-to-date on each of our policies. By obtaining and continuing to use our web hosting service, you are agreeing to all of the UsBizHost policies. Please be aware that these policies may change at anytime without advanced notice. UsBizHost is dedicated to providing an all-round top quality service. The terms and conditions which follow are necessary to ensure that we may continue to provide the best possible service to all of our customers while at the same time satisfying our legal and ethical responsibilities.

Failure to follow any term or condition will be grounds for immediate account deactivation without notice. USBizhost will be the sole arbiter as to what constitutes a violation of any of these provisions.

Legal Age - UsBizHost.com requires that its agreements be made with a person at least 18 years old. Otherwise, a parent or guardian must accept this agreement and be responsible for payment of Wired Hosting services and for Customer's compliance with this Agreement.

Limitation of Warranty - UsBizHost performs daily backups on all servers to ensure critical files are never lost. However UsBizHost is NOT responsible for lost data, time, income or any other resource due to faulty backups or nonexistent backups. UsBizHost.com makes no warranties of any kind, whether express or implied, for the service it is providing. UsBizHost.com is not be responsible for damages suffered by any customer, including incidental damages or lost profits. This includes loss of data resulting from delays, non-deliveries, misdeliveries, system failures or service interruptions caused by any source whatsoever. Customers understand and agree that UsBizHost.com has no obligation to maintain, protect or safeguard customers data stored and the customer agrees to accept responsibility for maintaining backup copies of all such data. UsBizHost.com does not claim to be free of errors or service interruption.

Use of service - UsBizHost.com's hosting accounts cannot be transferred or used by anyone other than UsBizHost.coms customers. Customers may not sell or lease UsBizHost.com's services to any party without prior approval of UsBizHost.com. Bandwidth use is expected to be reasonable and moderate. UsBizHost.com reserves the right to impose additional charges for use of bandwidth in excess of reasonable amounts.

Indemnity - Customers agree to defend, hold harmless and expeditiously indemnify UsBizHost.com from any claim, liability, loss, expense or damage arising out of the customer's breach or violation of any term, condition or covenant contained in this Agreement or resulting from the use of any UsBizHost.com's service.

As a provider of web hosting, UsBizHost.com Provides its customers the ability to establish websites for commercial and non-commercial purposes. UsBizHost.com realizes that websites on the Internet provide a wide a variety of information and opinions. UsBizHost.com does reserve the right to take necessary actions when a customer hosting a website violates the Acceptable Use Policy. If the Terms, Conditions and Acceptable Use Policy is revised, a customer's use of UsBizHost.coms services after changes are posted on UsBizHost.com will constitute the customer's acceptance of these changes.

UsBizHost.com's customers may not engage in the following prohibited activities:

Spamming - Sending unsolicited bulk and/or commercial messages over the Internet or having a site that is advertised in spam.**See footnote**
This makes you look bad and UsBizHost.com look bad.

Illegal Usage, Violating privacy, publicity, or other personal rights of others UsBizHostservers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: Pirated software, Hackers programs or archives, Warez sites, MP3, and IRC bots. The subscriber to UsBizHost service agrees to indemnify and hold harmless UsBizHost from any claims resulting from the use of the service that damages the subscriber or any other party.

UsBizHost will be the sole arbiter as to what constitutes a violation of this provision.

Intellectual Property Violations - Infringing on intellectual property rights of others (copyrights, trademarks, service marks, trade secrets, software piracy and patents. UsBizHost.com will block access to customer content upon receipt of a proper notice of copyright infringement. Termination of service may also result.

Obscene Materials - You may not use UsBizHost.com's services to transmit, store, advertise, display child pornography or obscene speech or material. UsBizHost.com will notify proper law enforcement agencies if this occurs.

Adult content - Due to special system and network requirements of adult oriented sites, pornography and sex-related merchandising are prohibited. This includes sites that may infer sexual content, or links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited.

Defamatory or Abusive Language - You may not post defamatory, harassing, abusive, or threatening language on your sites.

Distributing Viruses, Worms, Trojan Horses, etc… - You may not provide information regarding the creation of and sending of viruses, worms, trojan horses, pinging, flooding, mailbombing, or denial of service attacks.

Security - Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

Server Resource Any website that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given an option of either paying extra (which depends on the resource needed) or reducing the resource used to an acceptable level. UsBizHost shall be the sole arbiter of what is considered to be a high server usage level. Any attempts to undermine or cause harm to a UsBizHost server or customer of UsBizHost is strictly prohibited.

Any sub-networks of UsBizHost and dedicated servers must adhere to the above policies. The failure to meet or follow any of these guidelines are grounds for account deactivation. We reserve the right to remove any account without prior notice.

Software Distribution - UsBizHost's shared Web Hosting accounts are not to be used for the purposes of distributing and storing software and multimedia products, files . Any Web site whose disk space usage for storing the multimedia files exceed 50% of its total usage, either in terms of total size or number of files, will be deemed to be using unusual amount of multimedia files.

MP3, divx, movie - You may not use UsBizHost.com'services to store Warez, Hacking/Cracking, MP3 files, divx, movies

Illegal Activities - You may not use UsBizHost.com's services for ponzi schemes, pyramid schemes, fraudulently charging credit cards, and pirating software.

UsBizHost.com reserves the right to discontinue your services if any of your activites are harmful to its customers, customer relations or reputation whether those activities are legal or not.

Bandwidth Usage Policy

You are allotted a certain amount And charged for the extra

UsBizHost's bandwidth policy is simple! You are allotted a portion of bandwidth per month to do with as you please. You can use this bandwidth for anything you want besides things not permitted as outline in the Acceptable Usage Policy. If you go over your allotted amount of bandwidth in a given month, your account will not be suspended or terminated but you will be expected to pay for the additional bandwidth.

UsBizHost provides a bandwidth estimate figure in your control panel. This is an estimate and is provided from the server level. Actual account bandwidth usage is measured for billing purposes at the port level. This policy exists because many users offer files for download via FTP which is not otherwise measured by the server directly at this time. Please note that because the bandwidth is monitored at the port, any and all traffic for your Web Site is tracked including, but not limited to: FTP uploads and downloads, mail sending and retrieval, normal Web traffic, etc. Everything that is pushed from our server to a third-party's machine is considered bandwidth and will be measured.

We have designed this policy because many users find that hosts offer "unlimited" bandwidth only to find out that it has a very real bandwidth limit. Further, they place restrictions on what you can use the bandwidth for (i.e. no image galleries because they are a large source of bandwidth consumption). We tell you upfront how much bandwidth you are allocated each month and you have the full amount to use.

It is important to note that many sites don't use more than 1 GB of bandwidth. Your site has to be very popular or very graphic intensive to use more than 1 GB.

Script Usage Policy

We allow you to write scripts
using CGI, PERL and PHP!

Usbizhost provides our clients with web hosting accounts that permit the use of CGI files, PHP scripts, and other executable programs. Because these scripts use much more system resources than standard HTML pages, certain restrictions must be made governing the use of such "active content" systems.  Under most circumstances, we are able to pinpoint it to the offending account on the system. The following rules apply to all "active content" files as listed above:

 

Spam Footnote: - First define "spam." Spam is any unsolicited email whether commercial or non-commercial. You may or may not agree but that is my definition based on my research recently. A good definition is found here http://www.monkeys.com/spam-defined/

Absolutely no spam can be sent through Usbizhost servers or network. Absolutely no site can be hosted on UsBizHost servers or network that is advertised in spam. If you run any kind of newsletter or any other kind of bulk email service then you must have some evidence that people actually signed up to receive such email. Any and all spam complaints will be investigated thoroughly to determine if the complaint is legitimate. We will not take the word of the complainer. We must have proof from the one reporting the spam. Any user found to be spamming in any way or hosting a site advertised in spam will be given 30 days notice to either stop the spamming or come up with evidence to prove that the one reporting the spam actually did sign up to receive it or to find another host.

If you collect email addresses for bulk email the best proof is to collect as much information as possible about the person including the date and time and ip address at the time of sign up. It would be good to have their real name and address too. The more personal information you have about somebody then the better it is because it is unlikely that a spammer would have all that information. Be aware too that there are addresses out there that are planted for spammer to capture to be used in spam. These addresses are planted so that the receiver knows that the email is spam because those addresses are not used for any other purpose. So if you use software to scan newsgroups or websites to collect email addresses then you will be caught. Please don't do this. You also have to be careful about buying email lists from other companies. You need to verify that these addresses are legitimate and the people do want to receive what you are sending them.
